1. Service provider
Private passenger transport offered through this website is provided by M-DUB, Obrt za iznajmljivanje automobila, vl. Mirko Obradović, Nikole Tesle 3, 20000 Dubrovnik, Croatia. OIB: 39466887905. MB: 97330728.
Telephone: +385 98 963 1171. Email: info.mdub@gmail.com. Registered details are on the Legal Information page.
2. Scope of services
These terms apply to private passenger transfer services arranged through dubrovnikprivatetransfer.com. That includes airport transfers, other point-to-point transfers, and private journeys with a driver, including day trips and wine-route transport, when M-DUB confirms the journey.
These terms are not a car-rental agreement. They do not give the customer possession of a vehicle. A separate vehicle-hire contract applies only if M-DUB expressly agrees one in writing.
3. Transfer inquiries
The website form, WhatsApp, telephone and email are ways to ask about availability and price. Sending an inquiry does not create a confirmed booking. The website does not take payment.
The form prepares a WhatsApp message with the details entered. The message is sent only when the customer sends it in WhatsApp.
4. Booking procedure
A request should include the pickup location, destination, date, time and number of passengers, plus anything needed to organise the journey, such as luggage, a flight number or a request for a child seat.
M-DUB replies with availability and the price for the requested service.
5. Booking confirmation
A booking exists only when M-DUB confirms it, usually by WhatsApp, telephone or email. Completing the website form, or opening WhatsApp, is not by itself a confirmation.
The route, time, passenger numbers and price stated in that confirmation are the agreed service.
6. Prices
The price is quoted for the specific journey and confirmed before the booking is agreed. The confirmed price is the price for the service described in the confirmation. This website does not add a checkout fee.
If a requested change alters the agreed service, M-DUB will say whether it is possible and will confirm any revised price before providing the changed service. This website does not publish waiting, luggage, child-seat, extra-passenger or upgrade charges. None of those charges is added unless a revised price has been confirmed with the customer.
7. Payment
This website does not take card payments, deposits or other online payments. When a booking is confirmed, payment is made in the way agreed at that time. These terms do not set a deposit or a payment deadline beyond what is stated in the confirmation.
8. Pickup location
The customer provides an accurate pickup address or a clear meeting point. For a hotel, villa, marina or private address, include the name and any access detail the driver needs.
9. Pickup time
The pickup time is the time agreed in the confirmation. For a pickup that does not depend on a flight arrival, the passenger should be ready at that time and at the agreed place.
10. Airport transfers
For an airport transfer, the driver meets the passenger at the agreed point. Where meet and greet is part of the agreed service, the meeting point is confirmed before travel.
11. Flight number
If the transfer depends on a flight, the customer should give M-DUB the correct flight number. The website form has no separate flight field. The number can be included in the message or sent when the booking is confirmed.
12. Flight monitoring
Where the customer has given the correct flight number for an arrival transfer, M-DUB monitors the flight and adjusts the pickup to the actual arrival. This is the flight-monitoring practice already described for Dubrovnik Airport transfers on this website.
13. Flight delays
A delay of a flight for which the correct flight number was provided, and which can be identified, is not a no-show and is not treated as a late cancellation by the passenger. M-DUB adjusts the pickup as described above. These terms do not set a waiting-time charge or a maximum waiting period.
14. Customer delays
If the passenger is delayed for a reason other than a monitored flight, the passenger should contact M-DUB as soon as possible. M-DUB will try to continue the service where the schedule still allows it. These terms do not add a delay charge.
If the passenger does not arrive and does not cancel in time, the no-show rule applies, except where section 13 applies.
15. Waiting
A wait, a stop or a return can be requested. Where this website already says that waiting or a return can be arranged, that option remains available on request. Waiting that is not already included in the confirmed service is agreed separately before it is provided. These terms do not set a waiting fee.
16. Changes to bookings
The customer may ask to change the route, time, date, passenger numbers or other details by contacting M-DUB. A change is agreed only when M-DUB confirms it. If the change cannot be made and the customer does not wish to keep the original booking, the cancellation rule applies according to when the customer cancels.
17. Cancellation by the passenger
A booked transfer may be cancelled free of charge up to 24 hours before the scheduled pickup time.
If the transfer is cancelled at least 24 hours before the scheduled pickup time, the customer is entitled to a 100% refund of the amount paid for the cancelled service.
Cancellations made less than 24 hours before the scheduled pickup time are non-refundable.
Send the cancellation to info.mdub@gmail.com or +385 98 963 1171. The time M-DUB receives the message is the cancellation time. Further detail is on the Cancellation Policy page.
18. Cancellation by M-DUB
If M-DUB cancels the transfer and cannot provide an appropriate alternative service, the customer is entitled to a 100% refund of the amount paid for the service that was not provided.
19. No-show
No-shows without timely cancellation are non-refundable. A passenger is a no-show if the passenger does not appear at the agreed pickup location and time and has not cancelled in time. A flight delay covered by section 13 is not a no-show.
20. Number of passengers
The vehicle is arranged for the number of passengers stated, including children. If the number changes, tell M-DUB before travel. A material change may require a different vehicle, subject to availability, and will be confirmed before the journey. These terms do not set a charge per extra passenger.
21. Luggage
Please describe the luggage, including oversized items, so a suitable vehicle can be assigned. These terms do not set a luggage charge. If the luggage cannot reasonably travel in the confirmed vehicle, M-DUB will say so before travel and will confirm any alternative that is available.
22. Child seats
A child seat may be requested and will be provided where a suitable seat is available. M-DUB will say if a suitable seat is not available. These terms do not set a child-seat charge. Please give the age or size of the child when asking, so an appropriate seat can be considered.
23. Passenger responsibilities
The customer provides accurate contact and journey details, is at the agreed place at the agreed time (subject to a monitored flight delay), holds the documents required for the route, including border crossings, and follows lawful instructions needed to complete the journey safely.
24. Safety
Passengers use the seat belts provided. A child travelling with a seat supplied for the journey should use that seat. Follow the driver instructions on boarding, stopping and leaving the vehicle. Do not ask the driver to break traffic rules or to use a route the driver considers unsafe.
25. Passenger conduct
Behaviour that endangers the driver, other passengers or the vehicle, or that seriously interferes with the journey, may result in the service being refused or stopped where that is reasonable for safety. Mandatory consumer rights are not affected.
26. Vehicle category
The vehicle or category is the one agreed in the confirmation, chosen for the passengers and luggage described. Photographs on the website show the type of fleet. They are not a promise of one specific vehicle.
27. Substitution of vehicle
Where it is reasonably necessary, M-DUB may use a suitable alternative vehicle of a comparable category, for example because of a technical problem or an unexpected change in availability. M-DUB will tell the customer when this happens. These terms do not set an upgrade charge.
28. Circumstances outside reasonable control
M-DUB is not responsible for delay or non-performance caused by circumstances it could not reasonably control, including severe weather, a road closure, border delay, an accident or an official restriction, provided M-DUB tells the customer as soon as it reasonably can and tries to offer a practical alternative.
If the service cannot be provided and no appropriate alternative is arranged, the refund in section 18 applies to the amount paid for the service that was not provided.
29. Personal data
Personal data is used to handle the inquiry or booking and to provide the service, as described in the Privacy & Cookie Policy. Marketing consent is not required in order to request or book a transfer.
30. Written complaints
A consumer may submit a written complaint as described on the Written Complaints page.
31. Liability
Nothing in these terms excludes or limits liability that cannot be excluded or limited under mandatory Croatian or European Union law, including liability for death or personal injury caused by negligence where that liability cannot legally be limited. Subject to that mandatory law, M-DUB provides the confirmed transport service with reasonable care.
32. Applicable law
These terms are governed by the law of the Republic of Croatia. A consumer who lives in the European Union keeps the mandatory protections of the law of the country of residence where that law cannot be waived. The courts of the Republic of Croatia have jurisdiction, without affecting a consumer right to bring proceedings in the courts of the place of residence where EU law so provides.
